Terms of Use

These Terms of Use ("Terms") govern your access to and use of the LUMORY mobile application and any other services, websites, or applications provided by Ruvia Pte. Ltd. ("Ruvia Group", "we", "us", or "our"), a company incorporated in Singapore (UEN 202616961E).

By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services. These Terms constitute a legally binding agreement between you and Ruvia Pte. Ltd.

You must be at least 13 years of age to use our Services. If you are under 18, you represent that you have obtained parental or guardian consent to use the Services.

By using our Services, you represent and warrant that you have the legal capacity to enter into these Terms and that your use complies with all applicable laws and regulations.

To access certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration;

• Maintain the security of your account credentials;

• Notify us immediately of any unauthorised use of your account;

• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

Our Services allow you to create, upload, share, and interact with content including text, images, videos, audio, and AI-generated avatars ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant Ruvia Group a non-exclusive, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, distribute, and display your User Content solely for the purpose of operating and improving our Services.

You represent and warrant that your User Content does not infringe any third-party rights and complies with our Community Guidelines and these Terms.

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable laws;

• Post content that is defamatory, obscene, hateful, threatening, or harassing;

• Impersonate any person or entity or misrepresent your affiliation with any person or entity;

• Upload or transmit viruses, malware, or any other malicious code;

• Attempt to gain unauthorised access to any part of the Services or related systems;

• Scrape, crawl, or use automated means to access the Services without our prior written consent;

• Engage in any activity that disrupts or interferes with the Services;

• Use the Services to send unsolicited communications (spam).

Violation of these prohibitions may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.

All content, features, and functionality of the Services — including but not limited to software, text, graphics, logos, icons, and the LUMORY brand — are the exclusive property of Ruvia Pte. Ltd. or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of the Services without our prior written consent.

Our Services include AI-powered features such as avatar generation, personalised recommendations, and interactive experiences. These features are provided "as is" and may produce outputs that are unexpected or imperfect.

You acknowledge that AI-generated content does not reflect the views or opinions of Ruvia Group. You are solely responsible for how you use AI-generated content and must ensure such use complies with these Terms and applicable laws.

Certain features of the Services may be available for purchase. All purchases are final and non-refundable unless required by applicable law or expressly stated otherwise.

Prices are displayed in the applicable currency and may be subject to taxes. We reserve the right to change pricing at any time with reasonable notice.

Payments are processed by third-party payment processors. By making a purchase, you agree to their terms and conditions.

You may terminate your account at any time by contacting us at [email protected] or through the account settings in the app.

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content available through the Services.

To the fullest extent permitted by applicable law, Ruvia Pte. Ltd. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability to you for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or SGD 100, whichever is greater.

You agree to indemnify, defend, and hold harmless Ruvia Pte. Ltd. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with the Arbitration Rules of SIAC for the time being in force.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

We may revise these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or on our website and updating the "Last Updated" date. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
